Terms of Service<\/h2>

1. General provisions<\/strong><\/p>\n

1.1. The owner and administrator of the website www.menopauzesklinika.lt (hereinafter referred to as the Website), as well as the controller of personal data, is Menopauz\u0117s klinika, UAB, company code 307150055, VAT code LT100018036618 (hereinafter referred to as the Seller), registration address A. Rotundo g. 5-101, LT-01400, Vilnius district. correspondence address Rotundo g. 5-101, LT-01400, Vilnius, e-mail address \u2013 info@menopauzesklinika.lt<\/a>, tel. +370 629 42433.<\/a><\/p>\n

1.2. These purchase-sale rules on the Website (hereinafter \u2013 the Rules), together with the documents referred to herein, are intended to provide information to the client (hereinafter \u2013 the Buyer) about the Seller, and to inform the Buyer, who intends to purchase goods or services on the Website, about the conditions applied by the Seller. These Rules apply to the conclusion of any contracts between the Seller and the Buyer and determine the rights, duties, and responsibilities of both parties when purchasing goods and services through the Website. <\/p>\n

1.3. By using the Website and\/or its services in any way (registering on the Website or making a purchase without registering), the Buyer fully agrees and irrevocably undertakes to comply with all the requirements set out in these Rules. Before placing any order for goods or services on the Website, the Buyer is advised to carefully read these Rules and make sure they are properly understood. The Seller emphasizes that before finalizing an order, the Buyer must agree to these Rules and become familiar with the Privacy Policy; otherwise, order completion is not possible. <\/p>\n

1.4. Any information provided on the Website is not medical advice. The content of the Website cannot replace professional medical consultation and diagnosis. Before using supplements sold on the Website, it is necessary to consult a doctor or pharmacist. <\/p>\n

1.5. Medical services are provided remotely and in person. Services can be booked in advance on the Website or on the platform www.manodaktaras<\/a>.lt (see the rules of use here: https:\/\/www.manodaktaras.lt\/text\/taisykles<\/a>), as well as by calling the phone number indicated on the Website. Agreements regarding the provision of medical services are concluded upon arrival at the service location, Rotundo g. 5-101, Vilnius. <\/p>\n

2. Visitor Registration and Conclusion of the Purchase-Sale Agreement<\/strong><\/p>\n

2.1. The Buyer can fully use the Website and its services only after submitting all necessary personal data for the provision of services or purchase of goods, filling in all required registration fields (name, surname, address, e-mail address, phone number), and optionally filling in non-mandatory fields, thus providing the Seller with the information necessary to properly execute the order and\/or provide other services. <\/p>\n

2.2. The right to purchase goods and services on the Website is granted to:<\/p>\n

2.2.1. legally capable natural persons, i.e., individuals of legal age whose legal capacity has not been restricted by court order;<\/p>\n

2.2.2. minors from 16 years of age. Please note that some goods and services may only be used by Buyers under 18 with parental or guardian consent, but not all services can be provided to minors. Before purchasing goods or services, please contact the Seller regarding availability; <\/p>\n

2.2.3. legal entities;<\/p>\n

2.2.4. authorized representatives of all of the above.<\/p>\n

2.3. The contract between the Buyer and the Seller is considered concluded from the moment the Buyer selects the goods or services, forms a shopping cart, chooses a payment method, reviews the Rules, clicks the \u201cPay\u201d button, and makes payment, or otherwise confirms the payment method. This agreement is valid until all obligations under these Rules are fully fulfilled by both parties. <\/p>\n

3. Protection of Personal Data<\/strong><\/p>\n

3.1. The Seller processes the Buyer’s personal data in accordance with the Privacy Policy.<\/a> Considering that the Privacy Policy specifies important provisions of the Rules, the Seller recommends that the Buyer read them carefully and make sure that all provisions of the Privacy Policy are understandable and acceptable to him.<\/p>\n

3.2. By submitting their personal data to the Seller, the Buyer is responsible for their accuracy. If the Buyer\u2019s data changes, the Buyer undertakes to update it immediately in their Website account. <\/p>\n

4. Buyer\u2019s Rights and Obligations<\/strong><\/p>\n

4.1. The Buyer has the right to purchase goods and services on the Website in accordance with these Rules and must comply with the legislation of the Republic of Lithuania in force at the time of purchase.<\/p>\n

4.2. The Buyer (if considered a consumer within the meaning of Article 6.2281<\/sup>(2) of the Civil Code of the Republic of Lithuania) has the right to withdraw from the contract with the Seller by notifying the Seller by e-mail at info@menopauzesklinika.lt<\/a> within 14 calendar days from the date of purchase of the goods or services, in accordance with Article 6.22810 <\/sup>of the Civil Code of the Republic of Lithuania (this Article also specifies cases where the consumer\u2019s right to withdraw from a distance contract or off-premises contract does not apply). The consumer has the right to withdraw from the contract if the purchased goods have not been used, damaged, their usability has been preserved, and the goods have not lost their commercial appearance. Items that are unsuitable for return for health protection or hygiene reasons may be returned only if they were not unpacked. <\/p>\n

4.3. The Buyer undertakes to pay the agreed price for the goods or services ordered on the Website. Goods or services are considered paid for when a notification of payment is sent to the Buyer\u2019s specified e-mail address. <\/p>\n

4.4. Services purchased by the Buyer may be used only by one person. That is, when services, a course of procedures, or a discounted package of services are purchased, the services and procedures can be used only by one person; they are not to be shared or transferred, unless otherwise agreed between the Seller and the Buyer. <\/p>\n

4.5. Before the provision of services, the Buyer must provide the Seller with all known information about their health condition, allergic reactions, and medications used that may affect the provision of services. <\/p>\n

4.6. When registering, the Buyer must provide correct personal data and contact information. The Seller has the right to refuse to sell goods or provide services if the registration was created on behalf of another person or incorrect data was provided. <\/p>\n

5. Seller\u2019s Rights and Obligations<\/strong><\/p>\n

5.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided on the Website and to receive quality goods and services.<\/p>\n

5.2. If the Buyer attempts to damage the stability and\/or security of the Website or violates these Rules or other conditions specified on the Website, the Seller has the right to immediately and without notice restrict or suspend the Buyer\u2019s ability to use the Website, or to completely cancel the Buyer\u2019s registration.<\/p>\n

5.3. The Seller has the right, at its discretion, to set a minimum order size for goods or services, i.e., a minimum monetary amount below which the Buyer\u2019s order will not be executed. <\/p>\n

5.4. The Seller undertakes, at the Buyer\u2019s request, to provide additional information about the goods or services offered.<\/p>\n

5.5. Under certain conditions, the Seller may temporarily or permanently suspend the operation of the Website without prior notice to the Buyer.<\/p>\n

5.6. The Seller has the right to cancel the Buyer\u2019s order or pre-registration if the Buyer does not pay for the goods within 2 (two) working days.<\/p>\n

5.7. The Seller has the right to cancel the Buyer\u2019s scheduled visits and refuse to provide services if the Buyer reserved and booked times for the same procedure\/service several times without observing the recommended interval between procedures, or if the registration was created on behalf of another person.<\/p>\n

5.8. The Seller may refuse to provide services if the Buyer has obtained them dishonestly. For example, using a one-time coupon several times by changing their e-mail address, phone number, first or last name. <\/p>\n

5.9. The Seller has the right to refuse to accept a Buyer if the Buyer registers for visits and does not attend them, regardless of the circumstances of cancellation or previous payments for services. If the services were prepaid, the Buyer may be offered a refund of the remaining advance after deducting the Seller\u2019s losses incurred due to no-shows. <\/p>\n

6. Purchase of Goods and Services on the Website and at the Seller\u2019s Branches, Prices and Payment Procedure<\/strong><\/p>\n

6.1. The Buyer may pay for goods available on the Website as well as for services provided by the Seller 24 hours a day, 7 (seven) days a week. If the Buyer requires a VAT invoice for goods or services purchased at the clinic with cash or card, the Buyer may request it within 2 working days from the order placed at the Seller\u2019s physical branch. After more than 2 working days, invoices will no longer be issued. Invoices are issued only for those services that are actually provided to the client. Once an invoice has been issued, the service package can no longer be changed and money is not refunded. A Buyer requesting an invoice for services not yet provided agrees to these conditions. <\/p>\n

6.2. Prices of goods and services on the Website are indicated in euros, including value added tax (VAT). The price valid at the time of order confirmation on the Website applies to the purchased goods and services. <\/p>\n

6.3. Prices on the Website are indicated excluding shipping costs. Shipping costs are calculated at the end of the shopping process, after all goods are placed in the cart, before the Buyer confirms the order and pays for the goods. <\/p>\n

6.4. Each time the Buyer places an order, they confirm that they agree with the Rules in force at that time.<\/p>\n

6.5. Once the Buyer\u2019s order is received, a confirmation email will be sent to the email address specified by the Buyer. If an email with order non-confirmation is received, it means that the order was filled out incorrectly or the payment was not completed. <\/p>\n

6.6. The Seller confirms the Buyer\u2019s submitted order within 24 working hours from the moment of its receipt. Working hours are considered the Seller\u2019s working hours, calculated from Monday to Friday, 8:00\u201320:00. <\/p>\n

6.7. The Buyer undertakes to check whether all their personal data is correct. If discrepancies are found, the Buyer undertakes to correct the data and only then confirm the order. <\/p>\n

6.8. The Buyer may pay for the purchased goods or services by:<\/p>\n

6.8.1. cash, by prior arrangement and arriving at the address specified by the Seller within the agreed period;<\/p>\n

6.8.2. using the electronic banking system (via banklink<\/em>) \u2013 when advance payment is made through the Buyer\u2019s online banking system. To use this payment method, the Buyer must have signed an electronic banking agreement; <\/p>\n

6.8.3. credit card;<\/p>\n

6.8.4. Apple Pay or Google Pay systems.<\/p>\n

6.9. When purchasing goods or service packages by using the Seller\u2019s special offers and receiving a discount for selected procedures within service packages, such special offers and applied discounts are valid only on the condition that the Buyer uses the entire purchased service package. If, after selecting a service package and starting to use the services, the Buyer decides to cancel the package and submits a request for a refund for unused procedures, the discount applied to each procedure at the moment of purchasing the package becomes invalid. When refunding the Buyer for unused procedures, the discount applied to the services already received will be deducted. <\/p>\n

Example: The Buyer purchased a package of 8 procedures. The standard price of one procedure is EUR 50, but with the package, each procedure was discounted by EUR 10. The Buyer pays EUR 320 for 8 procedures. The Buyer uses 2 procedures and requests a refund for 6. The discount is annulled, and it is considered that the Buyer received two procedures at the standard price. The amount refundable to the Buyer for unused services is EUR 220 (320 \u2013 50 \u2013 50). <\/em><\/p>\n

6.10. The usual period for using service packages is 12 months. The Seller reserves the right, in certain cases, to specify another period for using service packages. In the cases indicated by the Seller, the Buyer has the right to use the amounts paid for a service package to acquire other services. After the expiration of the service package validity period, services are no longer provided and money is not refunded. <\/p>\n

7. Provision of Goods and Services and Quality Guarantee<\/strong><\/p>\n

7.1. The characteristics of each good or service sold on the Website are generally specified in the description provided next to each good or service.<\/p>\n

7.2. he Seller is not responsible if, due to the Buyer\u2019s individual physical characteristics, certain services cannot be provided. Such issues are discussed during a live consultation with the Seller\u2019s specialists. Services may not be provided if, prior to the start of service provision, it is determined that due to the Buyer\u2019s individual physiological and\/or health characteristics, the services cannot be delivered. In such cases, the Buyer may choose other services from the Seller or request a refund. <\/p>\n

7.3. If, in accordance with legal requirements, it is necessary to obtain the Buyer\u2019s consent prior to the provision of services, the services are provided only after obtaining such consent and after explaining the meaning and consequences of such consent. <\/p>\n

7.4. The Seller has the right to request a reservation fee from the Buyer, which is deducted from the service price at the time of the visit. If the Buyer fails to arrive at the agreed and pre-reserved time and does not notify at least 2 (two) working days before the scheduled date, the reservation fee is not refundable or transferable. If the Buyer has already prepaid for services, a reservation fee of EUR 30 will be deducted if the Buyer fails to attend the scheduled visit and does not notify at least 2 working days in advance. The Buyer understands that the reservation fee is considered minimal non-contestable damages incurred by the Seller due to the Buyer\u2019s failure to inform or late notification about their absence. <\/p>\n

7.5. The Seller undertakes to refund the Buyer the price paid for the good or service, replace or repair the good, or otherwise remedy the defect of the good or service when the good or service does not meet the conditions or requirements set out in the warranty document or in advertising provided at or before the conclusion of the contract, which are unrelated to the good\u2019s or service\u2019s conformity to the contract. <\/p>\n

8. Delivery of Goods<\/strong><\/p>\n

5.1. The Website indicates the estimated delivery time of goods, which is usually 2\u20135 working days. However, the Seller cannot guarantee delivery dates and is not responsible for delays caused by the services of third parties (couriers or delivery companies). <\/p>\n

5.2. Orders are delivered using OMNIVA and other parcel locker and courier services.<\/p>\n

5.3. The delivery fee depends on the quantity of goods and the delivery method chosen by the Buyer.<\/p>\n

5.4. The Seller is not responsible for delivery issues if they arise due to the Buyer providing an incorrect delivery address, contact details, or other circumstances attributable to the Buyer.<\/p>\n

5.5. If delivery of goods is impossible due to the Buyer\u2019s fault \u2013 for example, the Buyer provided an incorrect address or incorrect contact details, or did not accept the shipment at the specified address and agreed time \u2013 the Seller will once inform the Buyer of the unsuccessful delivery attempt using all available Buyer contacts and request updated details. If the second delivery attempt also fails, the Seller has the right to cancel the order. In this case, the Buyer will be refunded the price paid for the goods within 14 days, minus the delivery costs incurred by the Seller. <\/p>\n

5.6. Goods are delivered only within the territory of the European Union. Additional shipping fees may apply for orders delivered to the Curonian Spit in Lithuania, depending on the chosen delivery method. In Vilnius, goods can be collected or purchased at:<\/strong> Rotundo g. 5-101, LT-01400, Vilnius. Working hours:<\/strong> Mon\u2013Thu 8:30\u201317:00 (lunch break 12:00\u201313:00), Fri 8:30\u201316:00 (lunch break 12:00\u201313:00). <\/p>\n

9. Return of Goods<\/strong><\/p>\n

9.1. The Buyer, purchasing as a consumer, has the right to return goods within 14 days without giving any reason. The return period ends 14 days from the day the Buyer, or a third party indicated by the Buyer (other than the carrier), acquires physical possession of the goods. If, under a single order, the Buyer ordered more than one item and they are delivered separately, the return period ends 14 days from the day the Buyer, or a third party indicated by the Buyer (other than the carrier), acquires physical possession of the last item. <\/p>\n

9.2. Returned goods must be undamaged, have not lost their commercial appearance (labels not removed or damaged, protective films not torn, etc.), and must not have been used. The goods must be returned in their original packaging, with the same set of accessories as received, and accompanied by the purchase document, user instructions, and other product-related items. <\/p>\n

9.3. Goods are considered of acceptable quality if their expiration date has not passed, they do not contain prohibited ingredients under applicable law, they are not mechanically damaged, their packaging is intact, and there are no other quality defects.<\/p>\n
